The order directs the Department of Justice to investigate and prosecute individuals found guilty of desecrating the US flag.

    This executive order acknowledges the legal precedent established by a 1989 court decision in Texas, which determined the constitutionality of flag burning. However, the order suggests that prosecution may still be pursued if the act of flag burning triggers substantial societal unrest. The court, in a 5-4 decision, affirmed that the First Amendment protects flag burning as a form of political expression. Justice Antonin Scalia, a well-known conservative, was part of the majority in that ruling.

    On Monday, Trump asserted that flag burning is a catalyst for riots and societal disturbance. He underscored that the act can provoke violent reactions from those who are offended. According to Trump, the burning of a flag can cause widespread chaos, with many people resorting to violence.

    The executive order labels the desecration of the American flag as deeply offensive and inflammatory. It’s seen as a symbol of disrespect, animosity, and potential violence towards the nation. The order urges the Attorney General to prioritize the enforcement of existing criminal and civil laws related to flag burning, focusing on actions that cause harm independent of the First Amendment.

    The order stipulates a one-year prison sentence for flag burning, with no possibility of early release. It also outlines that foreign nationals involved in flag burning may face the revocation of their visas, residency permits, citizenship processes, and other immigration privileges, potentially leading to deportation.

    Trump expressed his disapproval of the court’s previous ruling. He noted that it was a 5-4 decision that classified flag burning as protected speech. He added that flag burning often leads to volatile situations and widespread unrest.
