Prayagraj. Allahabad High Court has given a big decision on Friday. The Lucknow bench of the High Court has declared the UP Board of Madrasa Education Act 2004 unconstitutional. The court said that this act is against the principle of secularism. The High Court has directed the Uttar Pradesh government to accommodate the students studying in madrasas in the basic education system. The division bench of Justice Vivek Chaudhary and Justice Subhash Vidyarthi gave this order. This decision came months after the state government decided to survey Islamic education institutions in the state. It also constituted an SIT in October 2023 to investigate madrassa funding from abroad. The investigation report recommended action against more than 13 thousand madrassas. Besides, strictness has been increased on madrassas on Nepal border.
This decision of Allahabad High Court came on the writ petition filed by Anshuman Singh Rathore. In this the powers of the UP Madrasa Board were challenged. Also, objections were raised on the management of the Madrasa by the Central Government, State Government and other concerned Minority Welfare Department.
