Mithun Chauhan was posted as Village Employment Assistant in Gram Panchayat Nalchha Dhar. Due to ill health, Mithun Chauhan could not attend work for one day. Mithun was removed from the post citing his absence for one day as misconduct.
Indore (MP High Court). Indore bench of Madhya Pradesh High Court has ordered to issue arrest warrant against Dhar District Collector Priyank Mishra and the then Chief Executive Officer of District Panchayat Shringar Srivastava. This order has been issued for not following the court order.
In this case, petitioner’s advocate Prasanna Bhatnagar said that petitioner Mithun Chauhan was posted as Village Employment Assistant in Gram Panchayat Nalchha, District Dhar. On 25 February 2017, he could not attend work for a day due to ill health. He was removed without investigation and without giving him an opportunity of hearing, terming his absence of one day as misconduct.
Writ petition was filed in the High Court
Challenging the said order, the Village Employment Assistant submitted an appeal, but the appeal was also rejected. After which he presented a writ petition in the Indore bench of Madhya Pradesh High Court in 2019. After this, the High Court accepted this and the order of termination of his service was canceled on 22 August 2023. Along with this, an order was also given that the Gram Rozgar Sahayak should be hired back with 50 percent of his previous salary.
Did not follow High Court order
An appeal was submitted by the government challenging this order, but on July 3, 2024, the appeal was also rejected. Even after the appeal was rejected, the order of the High Court was not followed. The petitioner submitted a contempt petition in which on 20 September 2024, instructions were given to the government to follow the order.
Along with this, be present before the court on 4 October 2024. Even after this, the order was not followed nor were the two officers present in the High Court. Therefore, arrest warrants have been issued by the court against the Collector and the Chief Executive Officer.
