Virendra Gahwai, Bilaspur. The Bilaspur High Court has given a big verdict regarding the recruitment of agricultural teachers in the state. Now B.Ed degree will be compulsory for agricultural teachers, and no discounts will be given in it. The Division Bench of Chief Justice Ramesh Sinha and Justice Ravindra Kumar Aggarwal has declared the provision of exemption unconstitutional and rightless. The court directed that the recruitment process should be completed according to the rules.
Explain that some applicants involved in the recruitment process of agricultural teachers had filed a petition in the High Court that they had passed a bachelor’s degree in agricultural science as well as B.Ed or Diploma in Elementary Education (DLED). He passed the Teacher Eligibility Test (TET). The petitioners challenged the state notification of 5 March 2019, with the requirement of compulsory B.Ed. During the hearing about the qualification for agricultural teachers in higher secondary schools, the court said that the removal of compulsory qualifications by the state government is against the rules of NCTE. The petitioners argued that such a discount weakens educational standards. The quality of education will be affected if permission to teach untrained persons.
On behalf of the state government, Additional Advocate General and Advocate of NCTE argued that it was necessary to relax the rules to overcome the shortage of agricultural teachers in the state. The main legal question before the court was whether a state government could relax the teacher qualification standard, which has been determined by the NCTE under the National Council for Teacher Education Act, 1993. The petitioners emphasized that under Section 12-A and 32 of the Act, NCTE specifically determines minimum qualification for teachers, and the state governments cannot unilaterally change these requirements.
