The Chhattisgarh High Court will soon hear a petition filed by the Congress party, which contests the current size of the state cabinet. The Congress alleges that the cabinet now comprises more ministers than the Constitution allows. The core of the argument revolves around the constitutional limit of ministers, which is capped at 15% of the total strength of the Legislative Assembly. Given Chhattisgarh’s 90-member assembly, the ministerial strength should not exceed 13.5. However, with the recent induction of three ministers on August 20, the cabinet’s count has reached 14, thus prompting the Congress to seek judicial intervention to address what it perceives as a violation of the constitutional provisions.
