The High Court has given a big verdict on the PIL presented in the case of providing free education under Right to Education (RTE) to the Economically Weaker Class (EWS) children. The couple of Chief Justice of Chhattisgarh High Court Ramesh Kumar Sinha and Judge Ravindra Kumar Aggarwal have directed the state government to formulate a clear policy within six months with an order on the matter. The court has given this decision aimed at ensuring free and compulsory education rights to children under Article 21A of the Constitution.
In fact, CV Bhagwant Rao filed a public interest litigation through advocate Devarshi Thakur, demanding free education to children of economically weaker sections of 6 to 14 years in private schools. He argued that under the Right to Education Act (RTE), these children should also get equal opportunities and the state government should make a clear policy on it.
Regarding the matter, Chief Justice Ramesh Sinha had reserved his order in the last hearing in the division bench, which has been issued today. The court said in its order that the state government has no clear roadmap on this subject. Thus, it is appropriate to direct the court to direct the state to formulate a policy in relation to the right to free and compulsory education to the children of the ‘economically weaker section’, so that the spirit and purpose of the RTE Act contained in Article 21A of the Constitution of India can be obtained within a period of six months from today as per the law.
