  • Supreme Court Rejects Plea Seeking Declaration Of Non-Consensual Unnatural Sex A Offence Under BNS |

    NEW DELHI: The Supreme Court on Monday refused to entertain a plea filed against the exclusion of the penal provisions for the offences of unnatural sex and sodomy from the Bharatiya Nyay Sanhita (BNS), which replaced the Indian Penal Code (IPC). A bench of Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra said the issue falls within parliamentary domain and it cannot pass any direction in the matter.

    “We can’t compel the Parliament to introduce laws. We can’t create an offence…This court under Article 142 cannot direct that a particular act constitutes an offence. Such exercise falls under parliamentary domain,” the bench said as it allowed the petitioner to approach the government with a representation on the issue.

    Section 377 of the IPC punished non-consensual “unnatural sex” between two adults, sexual activities against minors, and bestiality. On September 6, 2018, the Supreme Court, however, decriminalised same-sex relationships between two consenting adults.

    The BNS, which replaced the IPC, came into force from July 1, 2024. The court was hearing a plea filed by one Pooja Sharma seeking to address the “exigent legal lacuna” resulting from the enactment of the BNS.

    “The act of omission on the part of respondent (authorities) leaves the victims of non-consensual unnatural sex in dearth of any legal remedy, which would commensurate with the gravity of offence as were earlier defined under Section 377 of the IPC,” said the plea.

    In August, 2024, the Delhi High Court had asked the Centre to make its stand clear on the exclusion of penal provisions for the offences of unnatural sex and sodomy from the recently-introduced BNS, replacing the IPC, and said the legislature needs to take care of the issue of non-consensual unnatural sex.

    According to the information received from the police, the diet of Munishree Sudhasagar Maharaj was going on in Bhagyodaya Tirtha on Sunday morning. Meanwhile, celibate Aarti Didi asked Vishal Jain, a follower of the Jain community present there, to remove his hands. So that people can come inside the room. But he didn’t listen so Didi removed his hand. This matter took the form of a controversy.

    After this incident, Vishal Jain threatened Brahmacharini didi. After Munishree’s meal, he and his wife along with other companions started beating Brahmacharini Didi. Aarti didi told that when her nephews Mohit and Suyash came to save her, they were also beaten up. While alleging assault, tears started flowing from the eyes of celibate Aarti Didi. She looked very disappointed by this incident.

  • Violence Erupts In UP’s Bahraich As Man Killed Amid Durga Idol Immersion, 30 Detained |

    Tensions mounted in Uttar Pradesh’s Bahraich district on Monday as protests erupted following a violent clash in the Mahasi area during Durga idol immersion the previous day. A 22-year-old man succumbed to gunshot wound on Sunday during a communal face-off in Uttar Pradesh’s Bahraich. The clash broke out over music being blasted out from loudspeakers while goddess Durga procession was passing through Mahrajganj area of Mansoor village. Around six more individuals were injured during incidents of stone pelting and gunfire. Police have booked a man and detained over 30 people in connection with inciting the violence. 

    The Superintendent of Police (SP) in Bahraich, Vrinda Shukla, announced that 25 to 30 individuals have been detained as authorities work to restore order in the affected areas. She mentioned that a significant number of police officers have been deployed to manage the situation. She added that a case has been filed against a man named Salman, from whose house—also a shop—gunshots were fired.

    What Happened In UP’s Bahraich  

    A clash that began over a music dispute escalated dramatically following the gunshot death of Ram Gopal Mishra. The incident triggered anger among local villagers, leading to widespread vandalism as they damaged vehicles and set them on fire in the Maharajganj market. 

    Ram Gopal Mishra, a resident of Rehua Mansoor village, was shot while walking with the group. He was rushed to the hospital but succumbed to his injuries during treatment, according to a family member, reported PTI.

    Uttar Pradesh Chief Minister Yogi Adityanath condemned the violence, vowing that those responsible would face strict action. Following the communal tensions in the area, similar processions in Fakharpur town and other locations were cancelled. However, CM Adityanath said, “Idol immersion must continue.” He instructed authorities to ensure that idol immersions continue as planned, coordinating with religious organizations to ensure timely completion.

The accused has not yet been granted bail, that is why they had brought his dead body and they say that the accused is the only son of the deceased, if he had been granted bail then they would be able to perform the last rites of the deceased.

    Additional SP Ashok Joshi said that the family members of the deceased had also alleged that the accused was beaten up by the police. After investigation in the case, legal action will be taken against whoever is found guilty. On the orders of SP Saheb, all three policemen have been attached, they will take legal action after 7 days on the basis of the investigation report.

  • Baba Siddique Murder: Ossification Test Debunks Killers’ Claim Of Being Minor; Police On Lookout For Handler Zeeshan | 10 Points |

    Baba Siddique Death: NCP leader Baba Siddique was shot by three assailants outside his office in Nirmal Nagar and later succumbed to his injuries at Mumbai’s Lilavati Hospital. The 66-year-old former Maharashtra minister was buried with full state honors at Baba Qabrastan in Mumbai on Sunday. 

    Mumbai Police are investigating the case, and two of the three prime accused have been arrested. They will remain in custody until October 21. The third suspect is still at large. 


    Mumbai Police, investigating the murder of NCP leader and former Maharashtra minister Baba Siddique, conducted an ossification test on the accused, Dharmaraj Kashyap. The test confirmed that Kashyap is not a minor, officials said on Monday. 


    The arrested suspects have been identified as Gurmail Baljit Singh (23) from Haryana and Dharmaraj Rajesh Kashyap (19) from Uttar Pradesh. A third accomplice, who was present at the scene during the shooting, managed to escape and is currently on the run 


    The crime branch team produced the accused before the court, where Dharmaraj Kashyap’s lawyer argued that his client was a minor, according to an official statement. 



    The vacation bench ordered an ossification test for Dharmaraj Kashyap on Sunday, which confirmed he was not a minor, an official said. Kashyap was then produced before the court and remanded to police custody until October 21. 


    The fourth suspect in the murder of former Maharashtra minister Baba Siddique hails from Jalandhar, Punjab, police sources revealed. Identified as Mohammad Zeeshan Akhtar, he allegedly acted as the handler for the shooters, directing them from outside. 


    When Siddique was shot, Akhtar was reportedly providing real-time updates on his location to the gunmen. He also arranged logistical support, including renting a room for them. After the shooting incident, Akhtar fled and is believed to still be hiding in Mumbai, according to sources. Multiple police teams have been deployed to track him down. 


    In a late evening development, the Mumbai Police crime branch arrested 28-year-old Pravin Lonkar from Pune. He is the brother of Shubham Lonkar, who is linked to the Nirmal Nagar shooting case. The brothers planned the conspiracy to kill Siddiqui and brought Dharmaraj Kashyap and Shivkumar Gautam into the plot, according to an official statement.

    Reacting to the statement by farmer leader Gurnam Singh Charuni, he said, “There was resentment among the farmers. It is not that the farmers did not go with other parties.     “Elections are fought party basis, religion basis and caste basis. People will vote in favour of like-minded parties. The person who is a farmer, a labourer or a shopkeeper will vote for the party whose faith he has. They (farmers) all live together in the organisation. If a person starts considering the people of the organisation as being in his favour, then he is wrong,” he added.

    The BKU leader also raised questions on the veracity of EVMs. “You did not understand mathematics. The public has voted…but they (BJP) are the ones who win… Like sugarcane committee elections are being held in UP, their (BJP) direct game here is to cancel the nominations of the people of the other party and win without election,” he told IANS.

    “BJP people have become masters of elections… by fighting with sticks, with intellect, or by making people fight with each other, they will win the elections. This is their tactics that we (BJP) have not to give up power… we have to win the elections,” Tikait said.

    “There was definitely something wrong in this election (Haryana), we had said this earlier also. EVMs are kept somewhere and then when elections are held somewhere else. Are the EVMs shown to any party before they are sent to booths… the engineers do all the programme setting… yes, it is all a game of EVMs. You press any button…votes will go to them (BJP) only…,” he further said.

    Earlier in the day, Bharatiya Kisan Union (BKU) chief Gurnam Singh Charuni blamed former CM Bhupinder Singh Hooda for the party’s defeat in Haryana. “Hooda is the biggest reason for Congress’ defeat because he did not compromise with anyone, and all responsibility was placed on him,” he asserted.
