The apex court made it clear in its decision that the silence of the girl could not be taken in the form that no crime happened to her.

    What happened in Supreme Court

    According to media reports, the Supreme Court said that it is very sad that this minor girl and her family had to wait for about four decades to end this difficult chapter of their lives. The court also mentioned that it is true that the victim did not give any information about the crime with her. It is recorded in the trial court records that when asked about the incident, ‘V’ (the victim) remained silent, and he only shed tears when asked.

    The judges hearing the case clarified that this fact cannot be considered in favor of the accused. He also told that the reason for the silence of the girl was shock. In the context of the victim, the judges said that it would not be appropriate to put the entire burden of prosecution on him. The bench also mentioned that even if there are no condemnic statements, there is no rule to maintain conviction, especially when other evidence is available.

    There was a rape with a minor in 1986

    The incident took place in 1986, when a minor was raped. A person named Gulab Chand found the girl unconscious, and was bleeding from her private part. The trial court sentenced the accused to seven years in 1987. However, in 2013, the Rajasthan High Court acquitted the accused. After this, the victim’s family challenged the matter in the Supreme Court.
